PRIVACY POLICY EFFECTIVE AS OF 08/01/2024


This document, referred to in the General Terms of Use of the website https://antenor-auction.com (hereinafter the "Site"), aims to inform you about our practices regarding the processing and protection of your personal data, as defined below.
We invite you to carefully read all the information we provide, and if you have any questions, please contact us.

1- Définitions

"Data": Refers to any information that directly or indirectly identifies a natural person by reference to an identification number or one or more elements specific to them. You will never be asked to provide so-called "sensitive" personal data, such as your racial or ethnic origins, political, philosophical, or religious opinions, or information regarding your income or tax situation.
Your Data is collected strictly for the use and understanding of the Site and its Services, as well as for the purposes described in Article 4.

The Sales Operator acts as the data controller for your Data, which is collected during your use of the Site to provide you with the Services. This means that the Sales Operator is responsible for collecting, securing, and using your Data for the purposes described herein, in compliance with data protection regulations. The Sales Operator does not rent or sell its client files to third-party commercial companies unrelated to the Services as defined in the General Terms of Use of the Site.

Newsletter: An informational, promotional, or advertising email sent by the Sales Operator to Users who have provided their contact details for the execution of the Sales Operator's Services.

"Services": All services offered by the Sales Operator on the Site, as described in Article 3 of the General Terms of Use ;

"User" / "You": Refers to any person using the Services of the Site.

2 - Consentment

By using our Services, you agree to provide truthful information about yourself and understand and accept that your Data may be collected, used, stored, and transmitted to third parties as described below for the purpose of providing the Services you wish to benefit from.

3 - Data collected

We may collect the following categories of Data:

a. Navigation on the Website

Connection Data. Each time you log in to the Site, we passively collect information such as your computer's IP address, the date and time of connection, and details about your browser.
Browsing Data. We also collect information on how you access the Site, which pages you visit, and the duration of your visit.
We may use Cookies as specified below.

b. Purchase Orders, Telephone Bids, and Online Appraisal Requests

When you place a Purchase Order or a Telephone Bid, or when you request a free online appraisal, we collect certain information such as your first and last name, postal address, email address, phone number, date of birth, as well as your purchase history, the number of bids placed, and their amounts.
This information is required by the Sales Operator to comply with its legal obligation to formally identify clients, particularly in the context of anti-money laundering regulations.

c. Subscription to a Newsletter

In accordance with the General Terms of Use, when you subscribe to a Newsletter on the Site, you will be asked to provide certain Data, including your first and last name, postal address, email address, phone number, and date of birth.
This information is required by the Sales Operator to send you Newsletters tailored to your preferred object categories and auction specialties.

d. Banking Data

When you pay an auction invoice online, your banking data is requested to process the payment or to guarantee your participation in the auction.
When you make a deposit in advance, your data is requested to secure payment for a lot in case you win the auction. The Sales Operator may decide to hold the deposited amount before the sale as a guarantee until full payment is made.
However, this Data is transmitted directly to the Sales Operator’s payment service provider, Ingenico, which is PCI-DSS certified through its own services.
If you refuse to pay your invoice online, the Sales Operator will contact you and proceed with the payment using the methods described on the Site.
We do not store this Data, which is securely collected and retained by the Sales Operator’s payment provider, Ingenico, a PCI-DSS-certified entity. This international security standard ensures the confidentiality and integrity of cardholder data, securing card and transaction data protection.
When you place a Purchase Order or request a Telephone Bid on the Site, the Sales Operator requests your banking data to verify the validity of your bank account. However, this data is only retained for the duration of the auction.

4 - Purposes of Data Collection

Your Data is collected to enable us to provide you with the Services and fulfill one or more of the following purposes:
- Enable the use of the Site,
- Provide a history of Purchase Orders and Telephone Bid requests submitted,
- Ensure the proper execution of transactions initiated by Users, such as Purchase Orders and Telephone Bids,
- Provide a free appraisal service for listed items,
- Offer efficient customer service, including assistance with Site use and complaint management,
- Create a database of Users, clients, and prospective clients,
- Send Newsletters, solicitations, and promotional messages based on the selected preferences among the available object categories,
- Generate internal commercial and traffic statistics for the Services,
- Manage potential disputes related to the use of the Services and the Site,
- Combat fraud,
- Handle your requests regarding access, rectification, and opposition to Data collection,
- Comply with our legal and regulatory obligations.

We will inform you at the time of Data collection whether certain Data is mandatory or optional. If you do not provide the required fields, you may not be able to access the Services.

Subscription to our Newsletter is done via a checkbox on the corresponding page of the Site.

You may unsubscribe from Newsletters at any time by clicking the unsubscribe link at the bottom of the emails received.

If you encounter issues with the unsubscribe link, you can unsubscribe by sending a message to the email address provided in Article 13.

5 - Recipients of the Data

a. Our service providers

We share your Data with our own service providers located in the European Union, notably to perform services and actions on request and on our behalf, such as verifying the validity of your phone number, sending promotional and marketing emails or SMS, or managing your transactions.
We use and process your connection data to identify, limit, and eliminate malfunctions and errors in telecommunications systems.
We may also use the connection data to detect any illegal use of telecommunications systems and services.

b. Judicial authorities

In accordance with applicable legal provisions, the Sales Operator may be required to provide information to the competent authorities and courts for criminal prosecution purposes. The Sales Operator may not inform you of the disclosure of your Data to authorized third parties.

In case of violation of the General Terms and Conditions of Use or this Privacy Policy, the Sales Operator reserves the right to deny access to the Site's Services under the conditions described in the General Terms of Use.

The Sales Operator archives all data of successful bidders for ten (10) years from the end of the contractual relationship for billing and accounting purposes.

Likewise, the data of successful bidders are archived as part of the management of contracts between merchants and non-merchants or between merchants for a period of ten (10) years from the end of the contractual relationship.

7 - Security

We have implemented technical and organizational security measures to ensure the security, integrity, and confidentiality of all your Data, to prevent them from being lost, stolen, damaged, altered, or distributed to unauthorized individuals.

We store your Data on servers located within the European Union.

8 - Cookies

Cookies are text files stored in your browser. They are created when a user's browser loads a specific website: the site sends information to the browser, which then creates a text file.
Each time you return to the same site, the browser retrieves the file and sends it to the website's server.
When you visit the Site for the first time, a warning banner appears to ask if you accept the use of cookies while browsing. These cookies will be activated after your consent.

9 - User rights

The Data provided is necessary for the execution of the Services to which you have subscribed. You cannot withdraw your consent to the processing of Data necessary for the execution of the Service, unless you stop using the Services.
However, you can consult, modify, or request the deletion of your Data for legitimate reasons at any time using the contact details provided in Article 13 below. The Sales Operator provides information on the measures taken within one (1) month from your request. Requests for restriction of processing or data portability are handled under the same conditions. This one (1) month period may, however, be extended by two (2) months, provided you have been informed in advance of the reasons for the delay within the one (1) month period.
You can also object at any time to the processing of your Data to which you have previously consented, specifically for prospecting purposes.
The Sales Operator provides you, free of charge, with information about the Data stored concerning you. The information can be provided electronically if you wish.
For your security, please understand that in the case of a request for information or modification, we must verify your identity. Your ID will not be retained after your request.
The Sales Operator commits to notifying all recipients of the Data processing of your request.

10- Disposition of data after death

You have the right to issue specific instructions regarding the retention, deletion, and communication of your Data after your death, with your specific consent. You can modify or revoke these instructions at any time.
You can designate a person to carry out your instructions. This person will have the authority, upon your death, to be informed of the instructions and request their implementation from the Sales Operator. In the absence of a designation, or unless otherwise stated, in the event of the designated person's death, your heirs have the authority to be informed of your instructions and request their implementation from the Sales Operator.

In the absence of instructions or a contrary provision in your instructions, your heirs may exercise your rights to the extent necessary for:
- The organization and settlement of your estate. In this regard, your heirs can access the Data processing concerning you to identify and obtain relevant information for the liquidation and division of the estate. They can also receive information about digital assets or data related to family memories that are transferable to heirs;
- The acknowledgment of your death by the Sales Operator. In this regard, your heirs can object to the continuation of the Data processing concerning you or request its updating.

When your heirs make the request, the Sales Operator must justify, at no cost to the requester, that it has carried out the operations required by the heirs.
Disagreements between heirs regarding the exercise of these rights are brought before the competent court of first instance.

11- Modification of the privacy policy

The Sales Operator reserves the right to modify the Privacy Policy at any time, which remains applicable throughout the duration of the use of the Site and Services. In the event of a modification, the Sales Operator will inform you by email.

If you refuse these modifications, you agree to stop using the Services. Otherwise, your use of the Services is subject to the terms of the new version of the Privacy Policy.
Any access to the Services after the Sales Operator notifies you of the new version of the Privacy Policy will be considered as your full acceptance of the new version of the Privacy Policy.

The new version of the Privacy Policy applicable to the Services is available on the Site. The Sales Operator invites you to review it whenever you place an Order or make a Telephone Bid request, or an online estimate request.

The Sales Operator also reserves the right to modify or suspend, without notice, all or part of the Services.

Any modification or removal of the Services does not entitle you to any compensation for any reason.

12 - Disputes

In case of a dispute regarding the use of your Data, Belgian law is the only applicable law: The competent jurisdiction is in Belgium.
